By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Description of Services

Roofing Quote Tool provides an online estimation tool that generates approximate roofing cost estimates based on information you provide, including your property address, roof characteristics, and preferred materials. Our service is designed to give you a preliminary cost range and connect you with qualified roofing professionals.

The estimates provided through our Site are for informational purposes only and do not constitute a binding offer, contract, or guarantee of pricing. Actual roofing costs may vary based on factors including but not limited to: physical roof inspection results, local material costs, labor rates, permitting requirements, structural conditions, and scope of work.

2. Eligibility

You must be at least 18 years of age to use the Site and our services. By using the Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. User Obligations

When using our Site, you agree to:

• Provide accurate, current, and complete information when submitting a quote request
• Not use the Site for any unlawful or unauthorized purpose
• Not attempt to interfere with or disrupt the Site's functionality or infrastructure
• Not submit false, misleading, or fraudulent information
• Not use automated systems (bots, scrapers, etc.) to access or interact with the Site without our express permission
• Not impersonate any person or entity or misrepresent your affiliation
• Comply with all applicable local, state, and federal laws and regulations

4. Quote Estimates & Accuracy

The roofing cost estimates generated by our tool are approximations based on general industry data, the information you provide, and algorithmic calculations. These estimates:

• Are not guaranteed to be accurate or complete
• Do not constitute a binding quote, bid, or contract
• May differ significantly from actual contractor quotes and final project costs
• Do not account for site-specific conditions that can only be determined through physical inspection
• Are subject to change based on market conditions, material availability, and other factors

We recommend obtaining multiple quotes from licensed, insured roofing contractors before making any purchasing decisions.

5. TCPA Communications Consent

By submitting your phone number through our quote request form and providing your express written consent via the consent checkbox, you agree to receive communications from Roofing Quote Tool and its partners, affiliates, and authorized roofing contractors. These communications may include:

• Phone calls, including calls made using an automatic telephone dialing system (ATDS)
• Pre-recorded or artificial voice messages
• SMS/text messages regarding your quote request, roofing services, and related offers
• Email communications

You understand and agree that:

• Consent is not a condition of purchasing any property, goods, or services
• Message and data rates may apply
• You may receive up to 10 messages per month
• You may revoke your consent at any time by replying STOP to any text message, by calling us, or by emailing legal@roofingquotetool.com

6. Third-Party Contractors

Roofing Quote Tool may share your information with third-party roofing contractors and service providers. Please note:

• We do not employ, endorse, or guarantee any specific contractor
• We are not a party to any agreement between you and a contractor
• We are not responsible for the quality, safety, legality, or timeliness of work performed by any contractor
• Any disputes between you and a contractor must be resolved directly between the parties
• You are responsible for verifying a contractor's licensing, insurance, and qualifications

7. Intellectual Property

All content on the Site — including text, graphics, logos, images, software, design elements, and the overall look and feel — is the property of Roofing Quote Tool or its licensors and is protected by copyright, trademark, and other intellectual property laws.

8. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers & Warranties

THE SITE AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY ESTIMATES OR INFORMATION PROVIDED
• WARRANTIES REGARDING THE QUALITY OR PERFORMANCE OF ANY THIRD-PARTY CONTRACTORS

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ROOFING QUOTE TOOL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or business opportunities
• Property damage or personal injury resulting from contractor work
• Costs of procurement of substitute services
• Damages arising from reliance on estimates provided by the Site

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED ONE HUNDRED DOLLARS ($100.00) OR THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Roofing Quote Tool and its officers, directors, employees, agents, affiliates, and partners from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your interactions with any third-party contractor.

12. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.

14. Termination

We reserve the right to suspend or terminate your access to the Site at any time, with or without cause and with or without notice.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site with an updated "Effective Date." Your continued use of the Site after any modifications constitutes your acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
